Representative matters:

  • Successfully tried case for a fabric importer whose goods were held by a manufacturer without payment, and who then demanded the importer pay for storage fees in a cross-complaint.
  • Tried case for homeowner to void a purported height restriction on his home. The defendant claimed to have a valid covenant running with the land, which prevented Plaintiff from building an addition onto his home. At trial, the Court ruled for Plaintiff, finding that the purported covenant, drafted in 1976, did not restrict the homeowner’s ability to build as it did not meet the statutory or equitable requirements. After briefing and oral argument, the decision was unanimously upheld on appeal by the Second Appellate District, and a Petition by the Defendant to the Supreme Court was denied.
  • Represented a British Formula One racing team against a model company that had fraudulently filed for and obtained a trademark for its name in the United States. After a Permanent Injunction was entered by the Federal Court and the trademark was transferred by the model company back to the racing team, the model company was held in contempt of a Federal Court order by failing to abide by the Permanent Injunction. The model company is now subject to fines each time it violates the injunction, including $25,000 per violation, and $25,000 per day in violation.
  • Successful prosecution and defense of all kinds of business disputes: including partnership disputes, corporate dissolutions, distributor disputes, disputes between wholesalers and sales representatives, and disputes involving the ownership and control of intellectual property.
  • Extensive experience with all litigation tools, including alternative dispute resolution, writs of attachment, and all types of motions that can quickly and efficiently end litigation.
