Secured transactions

In addition to documenting and negotiating the loan, firm attorneys work with lending institutions throughout the life of the loan. This may include accounts receivable, financing, factoring, asset-based lending and equipment financing and leasing.

BANKING AND FINANCE REPRESENTATIVE MATTERS:

  • Formed a medium-size factor serving the apparel and soft good industries.
  • For a multinational motorcycle and watercraft corporation, we represent its U.S. financial division in the collection of loans against dealerships and franchisees across the nation.
  • Representation of several banks in connection with insolvency matters against third party debtors, including having them join in involuntary petitions in bankruptcy which resulted in money to creditors which otherwise would not have been achieved.
  • In a matter involving the foreclosure of a clothing company, we represented a national bank that was still owed nearly $15 million after liquidation. Firm attorneys took the account receivables, the bank’s only remaining assets, and collected a substantial amount, significantly reducing the bank’s shortfall.
