COMMERCIAL LITIGATION AND DISPUTE RESOLUTION
Our litigation counsel is a significant focus of the business-oriented representation we provide the apparel and textile industry, banks and financial institutions, manufacturers, and bankruptcy trustees and receivers.
When clients face legal conflicts at the state or federal level, Ezra|Brutzkus|Gubner LLP’s litigation practice group attorneys seek to reduce risks and minimize the drain and diversion of resources business disputes can precipitate.
Using our network of professional relationships within client industries and the legal community, we often are able to obtain early resolution. This means that companies can return to running their businesses sooner.
During the course of dispute resolution, should mediation, arbitration or a courtroom trial be necessary, firm attorneys are experienced in representing clients and their business interests throughout the entire legal process.
COMMERCIAL LITIGATION AND DISPUTE RESOLUTION REPRESENTATIVE MATTERS:
- In a case involving California Unfair Business Practices, Business & Professions Code Section 17200, and letters of credit, firm attorneys achieved a favorable and decisive resolution of the matter for a $100 million company and prevented similar claims from being filed in the future.
- In a consumer class action matter, we successfully defended a jewelry manufacturer who also faced claims from the Federal Trade Commission. Our client’s potential multimillion-dollar liability was reduced to a very small fraction of the original claim.
- Represented multimillion-dollar food manufacturer in the sale of its business. Firm attorneys protected the principal and created value for creditors and the Internal Revenue Service, even in the face of criminal and tax proceedings.
- For a multimillion-dollar wheel manufacturer sued for fraud by the company’s former owners, we achieved a decisive victory for our client who was ordered to pay nothing to the plaintiffs.
- We successfully defended one jean manufacturer over the placement of a label and prosecuted another over design appropriation claims.
- Represented a relative sued for malicious prosecution by another family member. Trial arguments by firm attorneys resulted in the court striking down the ability to sue for malicious prosecution in family law cases, a legal precedent that remains today.
- In an unlawful arrest case presented to the California Supreme Court, our attorneys’ defense arguments led the court to define privilege and end conflicting appellate rulings on unlawful arrest.
